TIPS FOR E-FILING A SUMMARY EVICTION
1. Search the court’s records to determine whether your tenant filed an answer in response to the eviction notice(s) you served.
- To check the court’s records:
- Go to https://lvjcpa.clarkcountynv.gov/Anonymous/default.aspx. Select “Civil Records”
- From the drop-down menu, select “Search by: Party”
- In the name fields, type your tenant’s last name and first name
- Click the “search” button
- If there are multiple tenants, search for each tenant’s name separately. Any one of the tenants could have filed with the court.
- Search all names (both landlord and tenant) that you listed on the eviction notice you served.
- An eviction case has an “E” in it and looks something like this: 14E000343
- Click on the case number to verify that you and your tenant are listed and that the date the tenant filed their answer is after the date they were served with the eviction notice that you are trying to file today.
2. If tenant filed an answer with the court in response to your eviction notice that you are trying to file today, you MUST use that case number (Tenant Answer case number) when you e-file your Complaint for Summary Eviction. Use the “File Into Existing Case” button to proceed. Choose Las Vegas Justice Court, and enter the case number, and Search button.
3. Before you e-file, review your documents.
- On the Complaint for Summary Eviction:
- Is the complaint signed?
- Is the signature legible?
- Do the names you listed on the complaint (both tenant and landlord) match exactly the names listed on the eviction notice(s)?
- Do tenant’s address and unit number on the complaint match exactly the address you listed on the eviction notice(s)?
- Did you verify tenant continued in possession of the rental premises following the expiration of the eviction notice(s)?
- On your eviction notice(s) and declaration(s) of service:
- Is there a checkmark or “X” next to the method of service used?
- Are all necessary signatures included and legible?
- Are all necessary dates included and legible?
- On the Certificate of Mailing:
- Is the USPS stamp (including the date) legible and dark enough to scan properly? (If not, use a copy machine to darken it and enlarge it.)
- Is the address of the apartment and unit number legible and dark enough to scan properly? (If not, use a copy machine to darken it and enlarge it.)
- On your lease:
- Are all signatures legible and dark enough to scan properly?
- Are all pages of the lease included? (If your copy is double-sided, you’ll need to make a single-sided copy so that all pages scan.)
4. Use the correct document code.
- The document code for a Landlord’s Complaint for Summary Eviction is: CVSELL
5. Include all necessary documents as one file in the correct order.
- Your documents must scanned into a single file and be in the following order:
- Complaint for Summary Eviction
- Eviction notice served on tenant
- Affidavit/Declaration of Service, if not part of the notice form
- Certificate of Mailing (if you served by a method requiring mailing)
- If you served a second eviction notice (such as a Five-Day Notice to Quit for Unlawful Detainer), repeat steps 2, 3, and 4 for the second notice:
- Second eviction notice served on tenant
- Affidavit/Declaration of Service for second notice
- Certificate of Mailing for second notice (if necessary)
- Lease agreement (if one exists)
6. In the “Document Title” field, list all titles of the separate documents you’re submitting as the lead document. For example:
- Complaint, Eviction Notice, Certificate of Mailing, and Lease Agreement
