2023 CHANGES TO TRAFFIC VIOLATIONS
The decriminalization of minor traffic violations.

Effective January 1, 2023, per NRS 484A.703, certain minor violations in Nevada will become civil infractions instead of criminal misdemeanors.

Criminal Misdemeanor vs. Civil Infraction

CRIMINAL MISDEMEANOR

A criminal misdemeanor is an offense that is punishable generally by no more than 6 months incarceration and/or $1,000 fine (NRS 193.150).

 

CIVIL INFRACTION

A civil infraction is NOT a criminal offense.  The penalty for a civil infraction is generally no more than $500.00 per violation, unless otherwise authorized by a specific statute.  (NRS 484A.7043).

WHAT DO I DO IF I RECEIVE A CIVIL INFRACTION?

Beginning January 1, 2023, any person who receives a civil infraction within unincorporated Clark County must respond to the citation as they would for a criminal citation. The deadline to respond to a civil infraction citation is within 90 calendar days after the citation is issued.  Your response can be either to pay the balance due to the Las Vegas Justice Court or to challenge the civil infraction citation.

Pay Balance Due: If you do not wish to contest (or challenge) the determination that you are liable for the civil infraction as stated in your citation, you may pay by visiting the Las Vegas Justice Court Customer Service windows in person at the Regional Justice Center. If this is your first citation within the last 36 months, you may be eligible to have a moving violation reduced to non-moving violation (Illegal Parking - 0 Demerit Points) by completing a Nevada DMV approved 5-hour traffic safety course or paying a Demerit Point Reduction Fee (in addition to the civil penalty)

Contested Infractions: If you wish to contest (challenge) your civil infraction, you must respond to the court in person and a court hearing date will be scheduled to contest the determination. A bond equal to the amount of the full payment of the monetary penalty, the administrative assessment and any fees specified in the civil infraction citation must be posted for a contested hearing.

 

PAYMENT OPTIONS FOR CIVIL PENALTIES

Payment options include paying your penalty in full, making payments towards the balance by the due date, or performing community service hours. 

Failure to respond to the civil infraction citation within 90 days, or failure to complete payment, will result in your case being referred to collections, possible suspension of your driver's license, and the appropriate demerit points will be referred to the Nevada Department of Motor Vehicles (NV DMV).
